Terms of Service

1. Who we are
CrabHub is a software service operated by Joshua Lee Parker, a sole proprietor doing business as "CrabHub" ("we," "us," or "CrabHub"). These Terms of Service ("Terms") govern your access to and use of the CrabHub website, applications, and services (the "Service").
2. Acceptance
By creating an account or using CrabHub, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
3. Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Payments, Merchant of Record & billing
Our order process is conducted by our online reseller and Merchant of Record, Paddle.com Market Limited ("Paddle"). Paddle is the merchant of record for all orders placed through CrabHub. Paddle provides all customer service inquiries related to orders, payments, taxes, and refunds, and handles the sale of the Service, including compliance with sales/VAT and consumer protection laws.
Your purchase is also subject to Paddle's Buyer Terms. Paid plans renew automatically at the end of each billing cycle at the then-current rate for your plan, unless you cancel before the renewal date. You can cancel any time from your billing portal; cancellation takes effect at the end of the current paid period.
5. Refunds
We offer refunds in accordance with our Refund Policy. Refunds are processed by Paddle. You can request a refund through paddle.net or by contacting us through our support form.
6. Acceptable use
You agree not to use CrabHub to break the law, infringe others' rights, harass anyone, transmit malware or spam, scrape or reverse-engineer the Service, resell the Service without permission, or otherwise interfere with the Service or its users. We may suspend or terminate accounts that violate these rules.
7. Your content and data
You retain all rights in the data, content, and materials you submit to CrabHub ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, process, display, and transmit Your Content solely to operate and improve the Service for you. You are responsible for ensuring you have the rights to submit Your Content and that it complies with these Terms.
8. Intellectual property
The CrabHub name, brand, logos, software, website, and all associated intellectual property (excluding Your Content) are owned by Joshua Lee Parker and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted, express or implied. You may not copy, modify, distribute, sell, or create derivative works of the Service, except as expressly permitted.
9. Termination
You may cancel your subscription and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ends and we may delete Your Content in accordance with our Privacy Policy's retention schedule.
10. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, our total liability to you for all claims arising out of or related to the Service will not exceed the fees you paid to us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Governing law
These Terms are governed by the laws of the United States and the state in which Joshua Lee Parker resides, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in that state, except where applicable consumer protection laws grant you rights that cannot be waived.
13. Changes
We may update these Terms occasionally. Material changes will be communicated via the Service or email. Continued use after changes take effect means you accept the updated Terms.
